Terms of Service

These Terms explain what you agree to when you install, access, or interact with TrustLogger.

Thank you for choosing TrustLogger. The following Terms of Service govern your access to the TrustLogger mobile application and related services provided by MidPulse Labs.

1. Acceptance of Terms

By downloading, installing, or using TrustLogger ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

2. Description of Service

TrustLogger is a mobile application that helps users:

  • Discover and explore National Trust properties across the UK
  • Track visits to National Trust sites
  • Save favorite locations
  • Share visit history with family and household members
  • View maps and site details

3. Eligibility

You must be at least 13 years old to use TrustLogger. By using the App, you represent and warrant that you meet this age requirement.

4. User Accounts

Account Creation

  • You must provide a valid email address and create a password
  • You are responsible for maintaining the confidentiality of your account credentials
  • You are responsible for all activities that occur under your account
  • You must notify us immediately of any unauthorized access to your account

Account Security

  • Choose a strong, unique password
  • Do not share your password with others
  • Enable two-factor authentication if available

Account Termination

  • You may delete your account at any time through the Profile settings
  • We reserve the right to suspend or terminate accounts that violate these Terms
  • Upon termination, your data will be deleted as outlined in our Privacy Policy

5. User Conduct

You agree NOT to:

  • Use the App for any illegal or unauthorized purpose
  • Violate any laws in your jurisdiction (including copyright laws)
  • Transmit any viruses, malware, or malicious code
  • Attempt to gain unauthorized access to the App's servers or databases
  • Interfere with or disrupt the App's functionality
  • Impersonate any person or entity
  • Harass, abuse, or harm other users
  • Upload false, misleading, or inaccurate visit information
  • Use automated scripts or bots to access the App
  • Reverse engineer, decompile, or disassemble the App

6. User Content

Your Visit Notes and Data

  • You retain ownership of the visit notes and data you create
  • By using the App, you grant us a license to store, process, and display your content as necessary to provide the service
  • You are responsible for the accuracy of your visit records
  • Do not include sensitive personal information in visit notes

Family Sharing

  • When you join a household group, your visits and favorites become visible to group members
  • You acknowledge that group members can view your visit history
  • You can leave a group at any time

Prohibited Content

Do not post or share:

  • Illegal content
  • Harmful, threatening, or abusive content
  • Content that violates others' privacy or intellectual property rights
  • Spam or commercial advertisements

7. Intellectual Property

Our Rights

  • TrustLogger and all related trademarks, logos, and content are owned by us or our licensors
  • The App's design, code, and functionality are protected by copyright and other intellectual property laws
  • You may not copy, modify, distribute, or create derivative works without our permission

Third-Party Content

  • National Trust site data and images are property of the National Trust
  • Google Maps content is subject to Google's Terms of Service
  • You agree to comply with all third-party terms when using integrated services

8. National Trust Affiliation

IMPORTANT: TrustLogger is an independent application and is NOT officially affiliated with, endorsed by, or sponsored by the National Trust. All National Trust trademarks, logos, and site information are property of the National Trust.

9. Location Services

  • The App uses your device location to show nearby National Trust sites
  • Location data is only collected when you use location-based features
  • You can disable location permissions at any time through device settings
  • Disabling location will limit certain features (nearby sites, map navigation)

10. Offline Functionality

  • The App caches site data for offline use
  • Actions performed offline are queued and synced when you reconnect to the internet
  • We are not responsible for data loss due to device issues or failed sync

11. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • Warranties of merchantability or fitness for a particular purpose
  • Accuracy, completeness, or reliability of site information
  • Uninterrupted or error-free operation
  • Security of data transmission

We do not guarantee:

  • That the App will meet your requirements
  • That site information is always current or accurate
  • That National Trust sites are open or accessible
  • That the App is free from viruses or malicious code

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • We are NOT liable for any indirect, incidental, special, or consequential damages
  • Loss of profits, data, or business opportunities
  • Damages resulting from your use or inability to use the App
  • Errors or inaccuracies in site information
  • Travel expenses or losses incurred based on App information
  • Unauthorized access to or alteration of your data

Our total liability shall not exceed the amount you paid to use the App (which is currently zero, as the App is free).

13. Indemnification

You agree to indemnify and hold harmless TrustLogger, its developers, and affiliates from any claims, damages, or expenses arising from:

  • Your use of the App
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Content you submit or share through the App

14. Third-Party Services

The App integrates with:

  • Google Maps - Subject to Google Maps Terms of Service
  • Supabase - Subject to Supabase Terms of Service
  • National Trust API - Subject to National Trust's terms

You are responsible for complying with all third-party terms when using these integrated services.

15. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective when posted in the App. We will notify you of material changes via:

  • In-app notification
  • Email to your registered email address
  • Updated "Last Updated" date at the top of this document

Your continued use of the App after changes constitutes acceptance of the new Terms.

16. Termination

We may terminate or suspend your access to the App immediately, without notice, if you:

  • Violate these Terms
  • Engage in fraudulent or illegal activity
  • Misuse the App or harm other users
  • Request account deletion

Upon termination:

  • Your right to use the App ceases immediately
  • We may delete your account and data as described in our Privacy Policy
  • Sections that by their nature should survive termination will remain in effect

17. Geographic Restrictions

TrustLogger is intended for users in the United Kingdom and displays National Trust sites located in England, Wales, and Northern Ireland. The App may not be available or suitable for users in other locations.

18. Governing Law

These Terms are governed by the laws of England and Wales, without regard to conflict of law principles. Any disputes will be resolved in the courts of England and Wales.

19. Dispute Resolution

Before filing a claim, you agree to try to resolve disputes informally by contacting us at support@midpulselabs.com. We will attempt to resolve the issue within 30 days.

If informal resolution fails, disputes will be resolved through:

  • Binding arbitration (if applicable in your jurisdiction)
  • Small claims court for claims under the jurisdictional limit

20. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force.

21. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and TrustLogger regarding the App and supersede any prior agreements.

22. No Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

23. Assignment

You may not assign or transfer these Terms without our consent. We may assign these Terms to any affiliate or successor without restriction.

25. Open Source Licenses

TrustLogger uses open-source libraries and components. A full list of third-party licenses is available in the App under Settings → About → Licenses.

26. Beta Features

The App may include beta or experimental features. These are provided "as is" and may:

  • Change or be removed without notice
  • Contain bugs or errors
  • Not function as intended

Use beta features at your own risk.

27. Force Majeure

We are not liable for any failure to perform due to circumstances beyond our reasonable control, including:

  • Natural disasters
  • War or terrorism
  • Government actions
  • Internet or telecommunications failures
  • Third-party service outages (Supabase, Google Maps, National Trust API)

By using TrustLogger, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service. If you do not agree, please uninstall the App and discontinue use immediately.
